This Privacy Notice describes how we collect, use, disclose, and otherwise process your personal information in connection with your use of the RubyCar's website and the products and vehicles we offer.

Although this Privacy Notice is not a contract, applicable agreements regarding a test drive, rental, vehicle purchase or the terms of use of our website may contain contractual obligations imposed on you or us, including terms governing any disputes regarding how we handle personal information which may include mandatory arbitration of disputes.

RubyCar may change portions of this Privacy Notice from time to time, so be sure to check back. If we make a change that significantly affects your rights, we will notify you by way of a prominent posting on our websites, e-mail and/or postal mail prior to the change becoming effective. OUR COLLECTION OF PERSONAL INFORMATION
Personal Information You Provide
We collect personal information when you give it to us via telephone, fax, postal mail, email, in person, or through use of RubyCar's website. The types of personal information we collect and share depends on the ways in which you engage with us or the products or services you have or request from us.
This information can include:

  • Name, email address, phone number and other contact information
  • Driver's license, Social Security number and other identification information
  • Bank account information
  • Credit history and credit score
  • Income, assets and liabilities

We may combine individual personal information with other information we received from other sources to provide a more customized and hassle-free experience. We may obtain personal information about individuals from a third party. Additionally, our affiliates and third parties may provide us with personal information about individuals.

Note About Test Drives: For each test drive, we collect the driver's name, location, contact information, and vehicle type preference. We will provide this information to an Avis or Budget location who will arrange for a test drive. The Avis Budget Group Privacy Notice describes how personal information will be collected, used and disclosed in connection with a test drive test drive is facilitated through one of the Avis Budget Group rental locations and not an independently owned licensee. If you have any questions about the privacy practices of an independently owned licensee, you should direct your questions to the specific licensee.

Personal Information Automatically Collected When You Use Our Online Services
When individuals visit and use our website or download our mobile application, RubyCar automatically collects personal information, including:

IP Addresses & other information collected automatically: We may collect an IP address when someone visits our websites to help us diagnose problems with our systems, for system administration, to report aggregated information to our business partners, and to audit the use of our website. In select circumstances, we may use IP addresses to help us identify a visitor when we feel it is necessary to enforce compliance with our Website Terms of Use or to protect our service, site, users or others. We may also collect a visitor's browser type, Internet Service Provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/ or clickstream data to analyze trends in the aggregate and administer the site.

Cookies & other data collection technologies: We use cookies, scripts, pixel tags, etags, web beacons and other data collection technologies to help us recognize visitors, remember their previous preferences, and determine their vehicle interests. We also use these technologies to track website usage trends and patterns, personalize features, and tailor advertisements. We share website usage information about visitors with selected third parties for the purpose of targeting our Internet advertisements on our websites and other websites that display our advertisements. We, and our third party partners, use the information collected through cookies and data collection technologies to: (a) remember information so that you will not have to re-enter it during your visit or the next time you use our online services; (b) provide and monitor the effectiveness of our online services; (c) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our online services; (d) diagnose or fix technology problems; (e) detect and prevent fraud or misuse; or (f) otherwise to plan for and enhance our online services.

ONLINE ADVERTISING
RubyCar uses third parties to provide online or electronic ads on our behalf. These third parties use data about visits to our websites usage to customize ads that may be of interest to our visitors.

This information is collected using cookies, scripts, pixel tags, etags, web beacons and other data collection technologies, which recognize the device you are using and collect information, including click stream information, browser type, time and date you visited the site, device ID or AdID, precise geolocation and other information. We and our advertising partners use this information to understand your browsing activities, including across unaffiliated third-party sites, so that we can deliver ads and information about products and services that are tailored to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics and market research.

Your Choices About Cookies
If you would prefer not to accept cookies, most browsers will allow you to: (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies. Please note that doing so may negatively impact your experience using our online services, as some features and services may not work properly. Depending on your device and operating system, you may not be able to delete or block all cookies. In addition, if you want to reject cookies across all your browsers and devices, you will need to do so on each browser on each device you actively use. You may also set your email options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our email and performed certain functions with it.

Your Choices About Online Advertising

Please note that opting-out of receiving interest-based advertising through the NAI's and DAA's online resources will only opt-out a user from receiving interest-based ads on that specific browser or device, but the user may still receive interest-based ads on his or her other devices. You must perform the opt-out on each browser or device you use. These opt-out choices may not affect online advertising that is not cookie-based. Some of these opt-outs may not be effective unless your browser is set to accept cookies. If you delete cookies, change your browser settings, switch browsers or computers, or use another operating system, you may need to opt-out again.

You may also be able to limit mobile interest-based advertising through the settings on your mobile device by selecting "limit ad tracking" (iOS) or "opt-out of interest based ads" (Android). Please note that when you opt of receiving interest-based advertisements, this does not mean you will no longer see advertisements from us or on our online services. It means that the online ads that you do see from NAI and DAA participants should not be based on your interests. We are not responsible for the effectiveness of, or compliance with, any third-parties' opt-out options or programs or the accuracy of their statements regarding their programs. In addition, third parties may still use cookies to collect information about your use of our websites and online services, including for analytics and fraud prevention as well as any other purpose permitted under the NAI and DAA programs.

Dealer.com. RubyCar website is provided by Dealer.com. The Dealer.com platform collects certain personal information in connection with the services it provides RubyCar and utilizes cookies and related technologies on the platform to collect personal information directly from you while you are on our website. Google Analytics and Advertising. We use Google Analytics to help us to better understand how our online services function on your device and for research and development. We may also utilize certain forms of display advertising and other advanced features through Google Analytics, such as Remarketing with Google Analytics, which uses third-party cookies (such as the DoubleClick advertising cookie) or other third-party cookies together to inform, optimize, and display ads based on your past visits to the services. Social Media and Advertising. We may also let you share some of our online content on social media websites through hosted sharing links and icons. We do not track or store a record of each time a third party shares our online content. If you choose to participate in posting or sharing activities, you should remember that it may be viewed by the public via our website, in RSS feeds, APIs (application program interfaces) and may also be made available to other websites. As a result, your public activities may appear on third-party websites, blogs, or feeds. RubyCar is not responsible for the information that may be shared publicly. Our websites may include social media features, such as the Facebook Like button. These features may collect your IP address, which page you are visiting on our website, and may set a cookie so that the Like button feature works properly. Any social media feature is governed by the privacy policies of the website providing the feature. We encourage you to read the privacy policies of any website you visit.

Do Not Track. Further, RubyCar is required to alert individuals how our websites react to Do Not Track signals. Some browsers support a "Do Not Track" feature, which is intended to be a signal to websites that a visitor does not wish to be tracked across different websites visited. We do not currently change the way our website operates based upon detection of a Do Not Track or similar signal.

MARKETING
RubyCar sometimes also shares personal information with third-parties to help us with our marketing and promotional projects, such as managing our social media pages, running contests, sweepstakes and other promotions, or sending marketing communications.

Individuals may decline to receive promotional and marketing emails and text messages from RubyCar by withdrawing consent at any time. See Individual Choices below for details

CHILDREN
RubyCar's website and services are not for children under the age of 13. This includes any links to other websites that we provide. We don't knowingly collect personal information from children for any reason. If you think RubyCar has received personal information of your child or another minor, please contact us.

INFORMATION SHARING
RubyCar may use and share individual personal information with third parties who perform services on our behalf. For example, we share information with vendors that assist with vehicle title and registration details.

We may share information with third party service providers that assist our customers in completing a transaction. For example, lenders such as financial service companies, banks and credit unions, to arrange financing, and to dealers, to complete a vehicle purchase transaction.

We also share information when required by law or when necessary to protect ourselves or other customers. For example, we will share information to respond to a subpoena or court order and we may share information when we are investigating a potential fraud.

We may also share information with third parties that perform administrative or marketing services on our behalf, such as printers and mailers that assist us in the distribution of materials.

We may also share personal information with third parties in the event of an actual or potential merger or acquisition, consolidation, change in control, transfer of assets, bankruptcy, reorganization, or liquidation.

INDIVIDUAL CHOICES
Individuals can opt out from marketing and promotional emails by:
  • Clicking "unsubscribe" at the bottom of an email we send.
  • Going to our Key Contacts section below to email or call a customer service representative.

Individuals can opt out from receiving promotional text messages by:
  • Replying to the promotional text message with the word "STOP".

If an individual does opt out of receiving promotional and marketing messages, we may still contact them regarding our business relationship with them, such as appointment status and updates, survey requests after they test drive with us, or respond to their inquiries or complaints, and similar communications.

SAFEGUARDS
The security of personal information is important to us. We take reasonable steps designed to protect personal information from unauthorized use, access, disclosure, alteration, destruction or loss.

We do not ask for sensitive information, such as credit card numbers, passcodes, account numbers or pin numbers, in an e-mail, text or on a website not operated by RubyCar or its affiliates. If you do receive a suspicious request, do not provide your information and report it by contacting one of our customer service representatives.

This Privacy Notice applies only the RubyCar service and online properties and not to the practices of any other Avis Car Sales entity. Our websites and Apps may include links to and from the websites of our affiliates and business partners. We do not control how personal information is collected or used on those websites, so please review the privacy policy of any website you visit as a result of following any links to or from the websites of our affiliates and business partners.

Scope of Disclosures

This California Privacy Notice (the "CA Disclosures") supplements the information contained in the RubyCar Privacy Notice and applies solely to individual residents of the State of California ("consumers" or "you").

These CA Disclosures describe how we collect, use, disclose, and otherwise process personal information of individual residents of the State of California, either online or offline, within the scope of the California Consumer Privacy Act of 2018 (CCPA). Unless otherwise expressly stated, all terms in these CA Disclosures have the same meaning as defined in our Privacy Notice or as otherwise defined in the CCPA.

Personal Information Disclosures

For purposes of these CA Disclosures only, we use the term "personal information" to mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

  • Information relating to our job applicants, employees, contractors and other personnel of RubyCar, which is not governed by these CA Disclosures.

The categories of personal information we collect may vary depending on the ways in which you engage with us or the products or services you use.   • To fulfill or meet the reason you provided the information, such as to process your transaction or respond to your inquiry, including to complete a vehicle purchase transaction.
  • To facilitate test drives of eligible vehicles, the evaluation of your trade-in vehicle and the transfer of the purchased vehicle into your possession.
  • To communicate with you, including via email, text message, push notification, social media and/or telephone calls.
  • To operate, maintain, and provide to you the features and functionality of the services.
  • To market to you, including through email, direct mail, phone or text message, and to run our contests, sweepstakes or promotions.
  • To personalize your experience and to deliver custom content and product and service offerings relevant to your interests, including targeted offers and ads through our websites, third-party sites, or on other devices you may use.
  • To recognize you and remember your information when you return to our websites and services.
  • To help maintain the safety, security, and integrity of our property and services, including RubyCar vehicles, technology assets, and business.
  • For testing, training, research, analysis, and product development, including to develop and improve our services.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • To ensure the security of our or another's premises, property or other assets.
  • To defend, protect or enforce our rights or applicable terms of service.

  • To evaluate, negotiate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of RubyCar's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by RubyCar about consumers is among the assets transferred or is otherwise relevant to the evaluation, negotiation or conduct of the transaction.

Disclosure of Personal Information
As described in our Privacy Notice, we share personal information with third parties for business purposes or we may sell your personal information to third parties, subject to your right to opt out of those sales (see The Right to Opt-Out of Personal Information Sales below).

We disclose your personal information to the following categories of third parties:
  • Our service providers: We engage a number of third-party service providers that perform business or operational services for us or on our behalf, such as website hosting, infrastructure provisioning, IT services, customer service, email delivery services, administrative services, marketing and advertising services, and other similar services, subject to contractual terms restricting the collection, use and disclosure of your personal information for any other commercial purpose.
  • Third parties at your request. We share your personal information with third parties with your consent or at your direction, including where necessary to validate your eligibility for third-party financing.
  • Our affiliate companies. We may share your personal information with other companies owned or controlled by RubyCar, and other companies owned by or under common ownership as RubyCar, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us, such as Avis Car Sales) and any subsidiaries it owns, particularly when we collaborate in providing the services to you;
  • Businesses as needed to provide services. We may share personal information with third parties you engage with through or to provide our services, or as needed to fulfil your request or transaction, including, for example, payment processing services or vehicle title and registration services.
  • Security providers. We may share your personal information with third-party security providers, for example, to detect, prevent, or otherwise address actual or suspected fraud, harassment, security or technical issues, violations of any law, rule, regulation or the policies of RubyCar;
  • Business partners. We may disclose personal information to third parties with whom we partner to provide contests, joint promotional activities or co-branded services, and such disclosure is necessary to fulfil your request or application;
  • Ad networks and advertising partners. We work with third party Ad Networks and Advertising Partners to deliver advertising and personalized content to you on our services, on other sites and services you may use, and across other devices you may use. These parties may collect information directly from your browser or device when you visit our services through cookies or other tracking technologies. This information is used to provide and inform targeted advertising, as well as to provide advertising-related services such as reporting, attribution, analytics and market research;
  • Analytics providers. We work with third party analytics providers to better understand the demographics of our users and visitors, and to personalize, enhance and improve our services;
  • Social networks. We may disclose personal information, such as a unique identifier, hashed email address, or information automatically collected through tracking technologies, to social networks for the purpose of displaying personalized advertising and content on those social networks;
  • Law enforcement and third parties pursuant to legal request. From time to time, we may disclose personal information as reasonably necessary to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;
  • Third parties in the context of a corporate transaction. We may disclose personal information as reasonably necessary to evaluate, negotiate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of RubyCar's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by RubyCar about consumers is among the assets transferred or is otherwise relevant to the evaluation, negotiation or conduct of the transaction.

In addition, we may disclose personal information to our financing partners with whom we work to facilitate vehicle financing and leasing. Please refer to our Financial Privacy Notice to learn more about how we use and disclose personal information in connection with these financial services.

In the previous 12 months, we have disclosed all of the categories of personal information we collect, explained in the table above, to third parties for a business purpose.

In the previous 12 months, we have sold, or we may sell in the future, the following categories of personal information to third parties: Identifiers (such as your name, email address and contact information), Commercial Information (such as products sold or considered) and Inferences (generated from your interactions with our services) to third parties such as our affiliates, business partners, and other third parties who may use this information to communicate with you or to offer you products and services that may be of interest to you, such as vehicle warranty services or roadside assistance.

Additionally, as is common practice among companies that operate online, we have permitted third party advertising networks, social media companies and other third party businesses to collect information directly from your browser or device through cookies or similar tracking technology when you visit or interact with our website, use our apps or otherwise engage with us online. For example, they may collect Internet/Network Information, such as a cookie or device ID, browsing history and website usage, Geolocation Data, and Inferences generated from your browsing history and interactions with our online website as well as other sites and services. These third parties use this personal information to serve targeted advertising or to personalize content and perform other advertising-related services such as reporting, attribution, analytics and market research. These third-party businesses may use such information for their own purposes in accordance with their own privacy statements, which may include reselling this information to additional third parties, including other advertising networks. The Right to Know

However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products and services or engage with you in the same manner.

California residents that have an established business relationship with us have rights to know how their information is disclosed to third parties for their direct marketing purposes under California's "Shine the Light" law (Civ. Code § 1798.83).

We will need to verify your identity before processing your request, which may require us to request additional personal information from you. We will only use personal information provided in connection with a Consumer Rights Request to review and comply with the request.

In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity, if the rights of another individual might be violated or as otherwise permitted by law. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.
