RUBYCAR DEFERRED PAYMENT OR 5.99% APR AND FREE DELIVERY PROMOTION TERMS AND CONDITIONS

VOID WHERE PROHIBITED OR RESTRICTED BY LAW

1. ELIGIBILITY: This RubyCar  Deferred Payment or 5.99% APR and Free Delivery promotion ("Promotion") is open only to legal residents of the 50 United States and the District of Columbia.  Employees of Sponsor and its affiliates, subsidiaries, and related companies, agencies, and immediate families (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those living in the same household, whether or not related, are not eligible.  This Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

(a)               For the Deferred Payment Promotion,  A Customer (defined below) may only choose the RubyCar 5.99% APR Promotion or the RubyCar Deferred Payment Promotion, but not both.  

(b)               For the Free Delivery promotion, the promotion is open to Customers who are currently enrolled in a curriculum of higher education (college, university, technical, vocational or religious) and those who have graduated or completed a curriculum of higher education in the last 12 months.  This "Free Delivery" promotion is not available for delivery to Alaska and Hawaii.  Proof of current enrollment or recent graduation/completion must be provided and subject to acceptance in the sole discretion of Sponsor (defined below).

2.                  RUBYCAR 5.99% APR PROMOTION TERMS: The RubyCar 5.99% APR Promotion is subject to credit approval. The RubyCar 5.99% APR Promotion offers an annual percentage rate ("APR") of 5.99% on the amount financed for up to 60 months. For a 60-month term, this offer would require 60 monthly payments of $19.33 per $1,000 borrowed. The RubyCar 5.99% APR Promotion is not available to a Customer who chooses the RubyCar Deferred Payment Promotion.

3.                  RUBYCAR DEFERRED PAYMENT PROMOTION TERMS: The RubyCar Deferred Payment Promotion is subject to credit approval. Subject to the details in the remainder of this paragraph and these Terms, the Approved Lender will defer the due date of the first payment that otherwise may be due on the purchase of the Vehicle until the later of ninety (90) days from the date of execution of the contract for the purchase of the Vehicle with Sponsor and the date of execution of the contract for financing of the Vehicle with the Approved Lender.  Solely by way of example, if a customer executes the contract for purchase of a Vehicle and for financing of the Vehicle on January 1, 2025, the first payment on the financing agreement with the Approved Lender will not be due until April 1, 2025. The RubyCar Deferred Payment Promotion is not available to Customers in PA or to a Customer who chooses the RubyCar 5.99% APR Promotion.  

4.                  SPONSOR: The Sponsor and administrator of this Promotion is RubyCar by Avis, 10536 Atlantic Blvd., Jacksonville, FL 32225 (the "Sponsor").

5.                  CUSTOMER AND VEHICLE: The Customer ("Customer") is the natural person who meets the eligibility requirements detailed above and who purchases a pre-owned vehicle from Sponsor (the "Vehicle") during the Promotion Period. In order for a Customer to be eligible to participate in the RubyCar 5.99% APR Promotion, the Customer (both Customers if the applicants for financing are joint applicants) must have a minimum FICO score of 780.  To be eligible to participate in the RubyCar Deferred Payment Promotion, the Customer (both Customers if the applicants for financing are joint applicants) must have a minimum FICO score of 700.  For determination of the FICO score, the Approved Lender may use FICO Auto 9, except that it may use Equifax Auto 9 to determine the FICO score of the Customer in FL, GA, NC, SC, TX & VA. Not all pre-owned vehicles will qualify. Certain restrictions apply.

6.                  PROMOTION PERIOD: This Promotion begins at 12:00 a.m. EST on May 1, 2025 and ends at 11:59:59 p.m. EST on June 30, 2025 (the "Promotion Period").

7.                  APPROVED LENDER: To be eligible to participate in the Deferred Payment or the 5.99% APR Promotion, Customer must be approved for financing of the Vehicle under a financing contract providing for up to a seventy-five(75)-month term through a lender approved by Sponsor (an "Approved Lender"), and approval must be obtained thru sponsor.  Customers choosing to purchase the Vehicle without financing or with financing through a lender other than an Approved Lender thru or by sponsor, are not eligible for participation in this Promotion.

 

8.                  AGREEMENT TO TERMS: Participation in this Promotion constitutes Customer's full and unconditional agreement to these Terms, the Sponsor's standard terms and conditions of sale of Vehicles (available here), and the Sponsor's decisions, which are final and binding in all matters related to this Promotion.   

9.                  PROMOTION DETAILS: Fulfillment of the Free Delivery Promotion  will be via the waiver of the delivery fee at purchase.  NO CASH EQUIVALENT, CASH REBATES, DISCOUNTS OR OTHER CONSIDERATION OF ANY FORM WILL BE PROVIDED TO FULFILL THIS PROMOTION.  If delivery is not requested by the purchaser, no equivalent benefit, compensation, discount or renumeration of any kind will be provided.  Promotion fulfillment is subject to standard delivery terms and conditions provided at purchase

10.              OTHER DISCOUNTS.  This Promotion may not be combined with any other promotion or discount offered, unless the discount is part of the advertised sale price.

11.              PAYMENTS TO LENDER.  CUSTOMER ACKNOWLEDGES AND AGREES THAT PARTICIPATION IN THIS PROMOTION, AGREEMENT TO THESE TERMS, OR ENTITLEMENT TO OR ACCEPTANCE OF THE PROMOTION AMOUNT DOES NOT ALTER OR AMEND ANY AGREEMENT CUSTOMER HAS WITH AN APPROVED LENDER AND DOES NOT RELIEVE CUSTOMER FROM MAKING ANY PAYMENTS TO THE APPROVED LENDER IN ACCORD WITH THE AGREEMENT BETWEEN CUSTOMER AND AN APPROVED LENDER.

12.              RETURNS.  If a recipient of any part of this Promotion returns the purchased Vehicle, eligibility for the Promotion is forfeited immediately.  Sponsor reserves the right to offset the amount of any funds waived, credited or discounted in this Promotion (the "Promotion Amount") against any refund or credit that otherwise may be due to the recipient of the Promotion Amount. 

 

13. RELEASE, INDEMNIFICATION, AND LIMITATION OF LIABILITY: By participating in this Promotion, each Customer hereby releases, waives all right to, indemnifies, and holds the Sponsor and its parents, affiliates, and subsidiaries, harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this Promotion or the acceptance, use, or misuse of any free delivery. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Sponsor will not be responsible for: a purchaser's failure to receive notices due to purchaser's spam, junk e-mail, or other security settings or for purchaser's provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Promotion; by any human error which may occur in the processing of data with respect to this Promotion; or any typographical, technological, or other error in the publishing of the offer, administration of the Promotion, or announcement of the Promotion. Sponsor reserves the right to cancel or modify this Promotion in a manner deemed appropriate by the Sponsor.
